Stress sickness, phased return to work - holiday pay?

Hi Everyone

I've searched the internet but can't seem to find an answer to this one.

I have been signed off work for a couple of weeks due to stress (I have lodged a grievance and this has now also been improperly handled). I'm a bit upset that this has fallen in my qualifying period as I obviously want my maternity pay.

Having spoken to the doctor he has signed me off for another 2 weeks with a view to phasing me back after this period (hopefully things will be resolved enough for me to do this at that point - grievance hearing etc).

I have 2 weeks booked off as holiday in April, it is also in my qualifying period.

If I am doing a phased return to work due to work stress do they pay for the hours you work only - as obviously this would impact my pay further?

Secondly, what happens with holiday entitlement, will they pay me less for my holiday? I haven't accrued the holiday yet - I am using it up due to my going on Maternity in early July.

The company I work for only gives the minimum so please assume there is nothing in my contract.

It's up to your employer whether to pay you in full while doing a phased return or to pay you for the hours you're working. They only have to pay you for hours worked, but it might depend on how much of a phased return you're talking about. If it's one week of working slightly shorter days then back to normal, they might just pay you in full, if it's a month of working 3 mornings a week then see how you are, they are less likely to do that obviously. You need to ask them.

Your holiday should be paid at your normal rate, regardless of whether you have gone back to work temporarily on reduced hours before taking it.
