NHS Bank contract & continuous service

In the NHS, would previous bank service be counted as counted towards continuous service? This would make the difference as to whether DH is entitled to redundancy (or more importantly for us, redeployment). His current contract is fixed term, but he's only held that for 18months, prior to that he was on bank. Thanks in advance

Oh, and before bank in current Trust he had NHS contract elsewhere - if that makes a difference?

When he began his new job was he still on bank and handed in his notice effectively to stop being on it when his new job began?

If yes and there was no break he should be fine.

If he stopped being on bank before beginning his new post, even by a couple of weeks, that might be considered a break in service.

He needs to speak to HR to confirm the time he has been on record working for the Trust to confirm this 100% (just in case it varies!)

Was his NHS contract in the same part of the NHS e.g. Within NHS England? It could make a difference if he moved from NHS Scotland to NHS England for example.

It might also impact how much work he was doing when on bank as well. Is he in a union?

Thank you. All NHS England. It was a full time role via bank pretty much (a full time community nurse post covered via bank). Now a FIxed term post in a different team in the same organisation. There wasn't a break between bank and new contract - he pretty much finished Friday on bank and started the fixed term the next Monday.
Problem is that the team he's now in is being reorganised and because he has only an 18mth service via a temp contract, he's just being given notice rather than redeployment.
The notice would be appropriate as it was only fixed term to end in April, but we just wondered if he shouldn't be considered for redeployment with the others (some have less months service, but on a perm contract)

You really need to check the local Leave Policy for the Trust he works in.
In my Trust bank employment does not count towards continuous service, it starts from when a permanent post is taken up.

I'm afraid I also think bank doesn't count towards continuous service, I am pretty sure it doesn't in our trust.

I think the problem is he may have expecting redeployment is his post was temporary not permanent and what they've decided to do is to just not renew his contract after that 18 months (if I'm understanding you correctly) which they are totally entitled to do, unfortunately, which means they have no obligation to redeploy him. I expect they expect him to go back to bank.

He really needs to check the information on his trust intranet site regarding redeployment and speak to HR for clarification but I think that's what has happened and the reason others are being redeployed is because they are on a permenant contract despite having worked there less time (though I could be wrong which is why he must check).
