can someone get a job with old employer after being made redundant??

Basically the situation is DP is being made redundant. Its a big company he works for and there is another position available he could go for at another site but its 30 miles away from home so he's not going for it and work are allowing him redundancy instead of trying to force him into the vacant position.

He has just under 20 years service so redundancy is a decent amount. We are also in the fortunate position where we could pay our mortgage and live off my salary alone if he isn't able to pick up another job (it would mean less going out, holidays etc, and hard going but it would be easily doable and we could survive) so he doesn't have the pressure of needing a job like other people may have.

Anyway the thing is the job that is 30 miles away is literally 1 mile from where I work so we could travel together to cut down costs, although I only work 4 days and slightly shorter hours by half hour at each end of day.

DS doesn't want to take this job as its not something he would want to do long term, so if he was to take it he would basically be looking for something else from day 1, thereby losing his 20 years redundancy payout. So we had come to the conclusion he would take his redundancy, then look for another job. However after redundancy would there be anything to stop the company taking him on at the other location if the other vacancy was still outstanding and he went for it?? He's not taking redundancy relying on this being the case but would it even be an option??

Well, we've certainly had people come back, but there's usually been quite a break in between - a couple of years or so. Some of them even come back as normal employees and not just as consultants on much more money than they were ever on before.

You can probably check the ACAS and/or CAB websites to see if there's any information on redundancy, redeployment and reemployment. Different companies may also have different policies.

My DH's company has a clause when making staff redundant that their settlement would need to be repaid if they are employed by the company again within 6 months.

As op said, the majorit of companies (ones with any sense anyway!) have a minimum 6 month clause re redundancy, but why take it if it's not what he wants, surely its a good opportunity to find something he'd prefer if you can manage on 1 salary for a bit?

Adarajames> He gets about £13k redundancy and he's not fantastically well paid and only comes out with just over £1k net per month. If he takes the other job with a view to finding another job and leaving then he won't get the £13k as he won't be taking redundancy. He's not relying on taking the other job so if he can't he can't was just something we were wondering as a possibility.

sorry misread your post, he may not even apply for it its just something we were wondering was even a possibility, after all a job is a job, if there happens to be nothing else about when he starts looking.

You said it yourself- if he takes the other job he won't be redundant so won't be entitled to redundancy pay. If he waits until after his employment has terminated and then applies, I would be surprised if his employer is happy for him to keep the redundancy pay. Plus redundancy pay is tax free so HMRC wouldn't be too happy about a tax free lump sum being paid to someone who in fact isn't really redundant.
