commission pay when on maternity leave

hi all,

my job includes commission which is sometimes paid 5 months in arrears.

I asked hr when I was 14wks pregnant and I was told I would be paid ALL my commission, on top of smp in the months it was due.

I get paid £70 a unit in the month after the unit is released. much more work is involved in selling the unit than releasing it.

When I handed in my matb1 form, I got a letter from my manager via hr which sets out 90% for 6 wks, then smp, no mention of commission.

I queried it with my manager who said he'll come back to me.

He hasn't, so I asked him today, he said one of the directors said there is no precedent (male dominated industry) but he would propose £35 for me and £35 for my mat leave cover - to keep them interested and working.

I'm not fussed on sharing my pay with anyone. I'm running myself ragged trying to sell as much as possible and now at 28wks pregnant they throw this at me.

I rang ACAS who said that the precedent IS there because when I'm on hols or off sick I don't have to share my pay with the person who releases the unit and mat leave is no different in that respect.

my manager proposes that when I return from mat leave my cover will have built up a bank of forward orders and I can enjoy £35 on each unit I release for them. I'm not interested in that - they might be great, but if I leave them with 50 and come back to 10, I'll be down a lot of money. If I didn't return to work due to illness I'd be waving that £ good bye anyway (no intention of this but you never know what the future holds).

If I were to agree a split £35/£35 isn't proportionate as more work goes into the selling than the release, I would propose £60/£10 - but they've ticked me off with their inability to keep their word, so I don't even want to suggest that.

I just want to commission I earned - am I right? why are they shifting the goalposts and trying to bargain with me now? can they legally do this?
