I have recently started with commission based job into it recuirtments which is very tuff to be honest .i work nearly the whole day sometimes even at nights screening the cvs on job boards .it hasn't beena month but my childminder costs are way to high .altough I am on a good commission structure but it's all luck .i am in a mess what to do .can a freelancer that's what my job says decide its work hours .i am confused as to how to negotiate with my employer and just work sometimg like 3 to 4 days a week saving on my money to childminder .my resume is shit so this job is imp to me with regard to hunting after some months .please advice

To be honest, if you approached me about a job, I wouldn't take it seriously. So I think you need to be thinking about more than which hours you work.

If they set your working hours, and you can't subcontract your work to another, then you are not self employed.

Recruitment isn't all luck; I remember you posted about this before and have no experience - is that you? In which case it may be time to rethink, maybe this isn't your forte. Without meaning to sound rude, if the way you type here is the way your emails to clients are written, I can't see any of them taking your seriously I'm afraid.

Thanks Patricia for the feedback but def this is not the way I write to my clients .I was just trying to get some feedback from others .
Since I am new I dont have much knowledge of being self employed and employed on others terms and conditions .Its way to different here.

I don't think recruitment can be luck.

What hours do you work and what do you want to cut it down to?

Do you have set targets? Can you meet those targets in the potentially reduced hours?

The basic rule is, as PatriciaHolm has said, that if someone else tells you what to do and when to do it, and you can't pass that work on to someone else in your place, then you are employed.

If you are simply given a commission structure, only get paid for any leads you bring in, don't have any obligation to work set hours, etc., and pay your own tax/NI then you are likely freelance.

I take it that your job is to scour the internet for potential employees for jobs? That sounds like a tough job to build a CV on. You need to be able to build a relationship in a moment and sell the job to the person, whilst at the same time selling the person to the employer.

Lougle you have hit the nail yup it's freelancing .sorry for bothering you again but can anyone guide me what is the rules or legalities evolved behind freelancing .
Such as

A) can I break my contract the way I want
B) can I decide my hours at my Ease

You've got it the wrong way around, really.

Your contract is a written record of the agreement you've made with the company you do work for. It tells you what you've agreed you'll do, how you'll do it and what they'll give you in return.

If your contract allows you to do your job any way you like as long as you do it, and you only get paid for what you've done, then you're probably freelance.

If your contract says you'll work certain hours, or so many hours per week, or certain days of the week, then that's what you must do and you're very likely to be employed even if they call you freelance.

You need to look at your contract and see what you've agreed to do.

I have to say that this job sounds like a complete non-starter. Generous commission only pay structures are only generous if you get the lead that qualifies for payment. The rest of your time is dead time. You will lose huge amounts of money in childcare before you make any money.

Do something with a wage to get your CV off the ground.
