Holiday entitlement

I am negotiating a new contract and the holiday entitlement is becoming an issue.

Manager saying I will have 16 days including BH

Gov website says 5.6 weeks in my case this is 22.4 days as I work 4 days a week.

I have directed him to government website, but just want to sure I am right as with his calculation I would have 5 days a year to take (after BH and Christmas shutdown)

Can anyone reassure me that they have to give me 5.6 weeks please.

Yes they have to give you 5.6 weeks, this is statutory minimum

There was a thread about this not long ago. The general consensus was that if you worked your hours over four days then you got 4/5ths of the holiday entitlement. Because to have a week's holiday you would only need to take four days from your holidays and not five.

Yes, as the gov website confirms, you get 5.6 weeks. That is on the assumption that full time staff don't get more than 5.6 weeks, as you should get the same if that's the case.

My guess is that he is trying to say (or pass on the message) 16 days PLUS bank holidays, but what he really means is 16 days plus 80% of bank holiday 'allowance'.

(The statutory minimum of 5.6 weeks is often implemented as 20 days + 8 bank holidays, 80% of which would be 16 days + 6.4 to give your total of 22.4).

While it wouldn't affect your entitlement as PP have set out above, whether you work Mondays or not is a real issue for many PT workers. There are at least 3 and sometimes as many as 5 Monday bank holidays in any calendar year. Depending on which days you work, and whether there is any flexibility with when you usually work, this can cause problems.
