How much notice do employers need to give....

Hello,

My 19yo daughter has recently started (what was supposed to be) a weekend job in a shop. I think she's really being taken advantage of though and she's being expected to work much longer hours than expected, during the week after college and all weekends with little notice. She's at work today (working like a dog on her own, whilst her manager sits in the stock room) and has been informed today that she has to work all day tomorrow. She said that she can't as she has plans and her manager has insisted that she has to. Her contracted hours are a minimum of 8 hours per week (she has been working in excess of 20), but it doesn't state how much notice her manager needs to give her, and if she can say no.

I'm having trouble finding what the law is on this. Does anyone know, please?

ACAS is your best option if MNet can't help you.

They can advise of the options available.

This is quite good but the rule is you can't be forced to work more than your contracted hours so she can refuse.

Of course she's not been there long so they can let her go so it's up to her to decide what to do.

Thank you for the responses. I've just had a read through some of the info and it looks like 12 hours notice is considered reasonablel. At least she knows what's what now. She also only needs to give one week's notice, which is good news if she can't reslove her issues with her manager.

What does her contract actually say?

butterfly1234 · 28/09/2014 13:49

Hi Flowery,

Under 'Hours of work', the contract sates 'You will work a minimum of 8 hours per week. Normal trading days are mon-sun. You may opt out of sunday working by giving 3 months written notice. Opening hours vary. Your manager will provide you with a roster detailing your hours and day'

There's nothing about max hours, amount of notice etc.

What did her offer letter state her working hours/days would be ? She could refuse to do more than she is contracted and definitely not other than on stated days. Might be easier to find something else though.

butterfly1234 · 28/09/2014 14:02

There's been nothing else in writing regarding her hours and days. Offer letter starts... We are deligted to offer you the part time, permanent postion...etc etc then... In confirmation of your terms and conditions...then goes straight to contract details incl hours of work as stated in my previous post.

Dd has told her manager that she is only available to work at weekends (as they'd previously agreed), Manager aparently not happy. Dd will see what happens when she's given the roter next weekend and if she's been put down to work more than the weekend, then she's going to give her week's notice and look for something else.
