made redundant help

I work for a large phone company that has been taken in to administration. I'm 5 months into my maternity leave. On the 19th of September I was emailed to say I was made redundant (no notice) in fact if it wasn't for Facebook I wouldn't of known my job was at risk. Anyway I asked about my smp and they said I would be paid from the 1st Sept to the 19th but anything after that would be claimed through government. My pay day is Tuesday so to prepare I rang payroll today to see how much I would be getting so I knew exactly what to tell them when I rang to set up my maternity allowance up ( I received my matb form back today from the company) my payroll team told me I would be getting nothing this month because I owe them money for taking all of my holidays for the year before I left for my maternity which I was told to do not only by my team leader but also hr. It's left me high and dry with no money to come in on Tuesday. I can't even get my redundancy pay for 6 weeks because I have had to claim it directly from government myself. I have rang acas and they couldn't even offer me advice they just told me to get legal help but never answered my question if that was legal for a company to take my maternity pay away. Has this happened to anyone else if so how did you deal with it? Is it right for them to leave me without money?SadConfusedConfused

Contact the job centre and CAB. It doesn't sound like the company has any money left, even if it wanted to continue to pay you. I wouldn't waste time on legal action as there won't be any money left to recover from the company.

Agree with the pp. You're highly unlikely to get anywhere in the short term by pursuing the company if they're in administration, so your best bet is to find if there's a way to get some income in the short term. I suspect you may be able to get some maternity allowance or similar, but you'll need to see a cab or job centre to find out what your options are.

The company may be acting wrongly, but that's something you should look at pursuing after you've sorted out the issue of your income first.
