NHs, protecting shift allowance, maternity leave

Does anyone have any knowledge about working for the NHs in Scotland, protecting a shift allowance and being forced back to work early from maternity leave to ensure that the shift allowance (which is being removed from all new employees as of sept) is protected?

It's not for me, but for my sister, who seems to be getting shafted by her bosses at the moment,

Her being on maternity leave shouldnt affect her if it only affects new staff and she isn't a new employee.

It doesn't sound right and I would surprised if her employer would try and do this to her as it's basic maternity discrimination. I think she should clarify.

If it only affects new staff why does she need to return from maternity leave early? Confused

It's because she,s moving from full time to part time, they,ve told her she needs to sign a new contract and therefore that has to be done before, and her be back at work, before the date that the payment protection comes into force. It just doesn't seem right to me,

Well, if the specification for removal of shift allowance is that it applies only to new employees then her response is that she is not a new employee therefore it doesn't apply.

If the specification for removal of shift allowance is that it applies to new employees and to anyone whose contract is amended after x date, then her response is that she is being treated less favourably because of her maternity leave and because of her decision to make a flexible working request. It is her decision when to return from maternity leave and penalising her financially for returning on the date of her choosing rather than earlier is unlawful discrimination.

Sorry to crash your thread but have you anymore info about the shift allowance being removed. I've not heard anything about this and neither has DH (both nhs Scotland)

How can they remove it. Aren't you signed p for agenda for change terms and conditions in Scotland!

Hi,

I am a bit confused about this shift allowance. If your sister is AFC then she will get enhancements on top of pay for working out of hours. It applies to all staff...new and old. I know some hospitals have protected the old system pay for a while longer (a year or so) but she will, eventually, end up on AFC pay.
Also, she does NOT need to sign a new contract. She is reducing hours in her present contract. Make sure her manager isn't pulling a fast one. I returned part time and you don't sign a new contract. Get HR to assist if needs be.

Agree with the above, I went part time after maty leave with NHS, no new contract, just a letter of variation if I remember correctly

I just signed a form showing a reduction in hours not a contract. Tell her to be careful they aren't trying to change terms and conditions.
