Sick leave ad FB

Staff member, A, is on sick leave on account of a physical complaint. Colleague, B, has reported seeing A tagged on FB undertaking an activity and is of the view that if A can do the activity, then she can come to work. A's absence is supported by Fit Notes from her GP. Both B and I know the full details.

Legally, how should I proceed? Colleague B told me this out of the blue, I had not voiced any suspicions. Should I ask B to show me, or just ignore altogether?

Please remember that people often upload photos several days/weeks after the event.

The pics could have been taken before "A" went on sick leave.

Ignore altogether and advise A to remove and block all colleagues from Facebook and change her name to something unsearchable.

Tell B to report to HR if B is that bothered.

Agree, photo could have been taken weeks ago.

Sick note does not mean you have to stay holed up at home.
If you are saying colleague A is off with say a bad back and was seen gardening bending lifting and you are HR have a word

Fairy and Finola : B believes the photo was taken during A's sick leave.

Bugsylugs : I too am of the belief that being on sick leave does not require being confined to bed/home, but you have the right idea re bad back + gardening.

Bear in mind I have not seen the photo myself: B has told me about it.

Should I ask B to show it to me? Or should I ask B to bring it to HR's attention and not involve me?

Before you make any accusations, you need to see the picture for yourself and be VERY sure of when it was taken. Is B likely to have any issues with A or in any way making the picture sound worse than it is?
I was off work with flu and received a call from a work friend warning me that another employee was spreading a rumour that I had a massive party, even going into detail how many people were there and that there was nowhere to park on the street. She knew this because her daughter's best friend lived on the road and she saw it with her own eyes. It was total bullshit. Everyone thought butter wouldn't melt in this persons mouth! I knew better. Luckily my boss knew me better than that.

Colleague A could have done the activity long before they went on the sick. Don't automatically assume that they have done this recently.

Colleague A could of done this activity weeks ago. Colleague B sounds like a complete shit stirrer who I would hate to work with.

It really annoys me that employers seem to think they own the staff that work for them.

I'd let it lie, unless you have other concerns. I think context depends a bit here - how long have they been off for, are they generally a good worker etc.

Colleague should formalise her complaint and provide screen grabs if available.

She has every right to be concerned if someone is off and it's not legitimate. If she's claiming OSP then it's fraud. At the very least she's making extra work for colleagues.

I will never understand why people have such a problem with wanting their colleagues to only be off if legitimate. Why shouldn't people be cross if they think someone is taking the piss?

If I was the manager of A I would want to see a screen shot of the photo. I'd then call my HR rep and discuss it. I would not want one of my team ripping off the company.

If I was the manager if B, I'd offer to speak to the manager of A.

If I was no ones manager, I'd not want to get involved!!
