Hello

Am currently employed in a part time position, 3 days a week, which is clearly a full time role. The role is set to become even bigger to improve efficiency. However, I have been been put on redundancy notice if I do not go full time.

I really don't want to go full time, and if they cannot place me part time in another role I will be forced to take redundancy.

Is this ok?

They can ask you to change the terms of the contract and if you refuse, they can terminate your contract and offer you a job with the new terms and conditions, which you can accept or decline.

Thanks lougle, I had a look at the link and it would appear this is constructive dismissal!

They have given me a very vague letter not really telling me what my options are and asking me to come up with scenarios to appease both parties. However, this is not really possible as I don't know what my options are!

If you are made redundant it wouldn't be constructive dismissal. If the redundancy wasn't genuine or was unfair in terms of procedure or selection, it would be unfair dismissal not constructive dismissal.

Have they made any attempt to recruit a job share or similar, to fill those extra hours? You say it is clearly a full time role, and while they should make reasonable effort to find other ways to meet the business need, ultimately if you don't want the extra hours, and they either can't find a suitable job share, or a job share wouldn't be possible, then dismissing you as a last resort might be a reasonable decision for them to make.

Are there any other ways the work could be done? Any changes in processes or procedures, any other restructuring, can you compromise and increase a bit but not full time? Maybe phase it so you increase to 4 days for x months and then increase again? Any ideas you can think of about how their need can be met will help you.
