Right to return to your job

This lady is fighting for all pregnant women's right to return to their job after maternity leave. It is already a legal right but apparently some employers think they can ignore it. Some very anti-women and anti-matenrity comments written on the Daily Mail.

There's no right to return to the same job after a year but it has to be same grade and terms I think. Unless it has changed recently.

Returning to work after Statutory Maternity Leave

When returning to work after Ordinary Maternity Leave (the first 26 weeks of your Statutory Maternity Leave), you have a right to the same job and the same terms and conditions as if you hadn’t been away.

Yes but that's after 26 weeks. After 52, additional maternity leave, you no longer have the right to the same job

Well, it's unclear what job (if any) was available for her after her maternity leave but agree that she had no right to return to her exact job after taking a year off. Suspect she may lost this case unless there is a lot more than is in the new story - which, given that it's the Daily Fail, there probably is!

The "default" should be the old job but the employer can change this under certain circumstances:

When returning to work after Ordinary Maternity Leave (the first 26 weeks of your Statutory Maternity Leave), you have a right to the same job and the same terms and conditions as if you hadn’t been away.

This also applies when you come back after Additional Maternity Leave (the last 26 weeks of your Statutory Maternity Leave). However, if your employer shows it is not reasonably practical to return to your original job (for example, because the job no longer exists) you do not have the same right. In that case, you must be offered alternative work with terms and conditions as if you hadn’t been away.
