Are you entitled to see a copy of their complaint?

TIA

I highly doubt it

I would expect details to be kind of released as I cannot see how you could begin to defend yourself otherwise. Have you reviewed your bullying and harassment policy? It should be pretty clear...?

Please note that IT systems will be searched, emails, messaging systems, all colleagues will be interviewed in a total 360 kind of appraisal. Or at least in my old firn that's what happened.

Not what happened here.

Are you being disciplined? I think then you have a right to see the complaint.

I'm guessing you don't belong to a union or you would have contacted your rep before now.

Have a look at the ACAS site for advice.

Not myself billy no but my line manager by one of my colleagues who is technically no longer under her.

Its all very complicated but this colleague was in the process of being disciplined out last year, then I returned to work in November(had taken voluntary redundancy then option of returning came up a few months later in part because of my colleagues work performance) he then moved under a different 'manager' who is his best friend since school so the disciplinary process wasn't followed through.

Both of these guys have done some shitty things over the last few months, my manager is the only one who challenges them on what they are doing(ie accountability) which they don't like. Its hard not to get involved with them though as we are sales and they are meant to be technical support but in actual fact they end up getting themselves involved in jobs that they should be passing off to others. This has resulted in some duplicated work being done and some right royal fuck ups.

Anyway this guy is now saying my manager is bullying him and degrading him, I think because she questions him in front of others? ie she'll say 'what about x?' or 'why have you done y?' but we don't really know.

I've told her to contact ACAS get the staff handbook(though for the life of me I cannot find it on the network) and speak to her home insurance about legal cover but she just seems in total shock. There have been a lot of tears!

ACAS do actually say that during complaint procedure the employer should show the employee all the facts found during the investigation including written witness statements and evidence so yes I guess the original complaint would be classed as evidence
