Employer not paid wages at all

Hi

I was wondering if someone could offer me some advice please.

My partner was signed off from work by the doctor for stress and as procedure his employers ask that they contact a third party company when they are sick. My partner followed the correct procedure calling this company etc.

Then on pay day we checked the bank and he wasn't paid anything at all, he checked with payroll and they informed him his manager put him down as 5 days unpaid, through the post he then received an AWOL letter so called his line manager re confirming that he was signed off sick and had been calling this company which his manager was fine with and just told him to get the next sick note in ASAP. He has checked with payroll again today and once again this manager has told payroll to not pay him at all.

He has worked here for 7-8 years and in the past himself and others get paid for sick but on this occasion have paid him nothing, not notified him of no payment and not even paid statutory sick pay.

Can they pay him nothing?? I would have thought IF they decided not to pay him normal pay despite being signed off by a doctor they should of at least paid stat sick pay?? And ensure he was informed?

Any advice would be very welcome :)

Thanks in advance

Hi. I'm sorry I can't give you any advice but there is another thread going on at the moment regarding another employment issue and one of the posters works in HR and another in Employment Law so hopefully they will see your post and have some good knowledgable advice for you. Good luck.

This sounds to me like the manager does not know the procedure and is putting your DH down as 'absent' in the company systems which triggers a zero pay in the payroll system. Your DH needs to speak to payroll and HR not his manager to clear this up.

Big company payroll systems are byzantinely complex and things like this often happen. I would write a formal letter or email to the relevant person in HR once your DH has spoken to him/her to set out clearly what has happened and request a special payment.
