please help, at my wits end (sick pay)

i have posted here recently about grievance procedures and being signed off with stress and things have gotten worse. apolgies if i am long winded but i haven't recieved any advice from boss or HR and only have my own limited knowledge to go on.

during the 4 week payroll period, i worked for 39 hours, was absent for 1 hour (at boss' request), and was signed off sick by the doctor for 32 hours (4 in second week, then 18 and 10 in the following two weeks). i worked 17 hours in first week.

i have been paid for 39 hours work and marked as absent for 33 hours and have not recieved any sick pay, i work 18 hours a week at minimum wage and as far as i can tell am definitely entitled to both company and statutory sick pay.

i understand the first three days you are off sick you are not paid, and this would cancel out the first 4 hours for the first week but wouldnt affect the following two weeks as i was signed off from wednesday and the week starts on a sunday.

i have spoken to my manager and she agrees that i was signed off for a total of 32 hours and she did put me through as sick not absent. i have gone round in circles with her, wages dept and now HR since friday and am getting no-where, Wages phone boss, boss relays information then i phone them (they never phone me back) and they tell me i am only owed 8 hours and will be added to my next pay. i double and triple checked everything and still didnt agree so my manager advised me to try HR, have phoned HR several times since last night and they havent got back to me, the last time i phoned i was told that my messages had been passed on but the girl had left the office.

i used what wage i did have to pay off bills, tomorrow my meter is going to run out, i dont have much food left, amd.obviously christmas is coming up very soon, so i am getting desperate. i have told them i have no other income or financial support but they just always say "we will take a look at it/speak to manager and call you back" but they never do, i keep having to chase them and even then im lucky to get hold of the right person. HR girl told me she would call my boss and ringe straight back, i rang her office three times today and each time she wasnt available but i was assured she would call back. i called at about half six and she had left, despite being given my messages. surely a call even to let know i am totally wrong or put me in the picture isnt much to ask?

can anyone tell me if i am right and shoud have sick pay and also if there is amything i can do to get a quick result? i need this sorted tomorrow or i'll be sitting in the dark with sod all to eat.

sorry this is all a bit vague im irrationally upset by it all and probably not that coherant Sad .

It's not clear from your post I'm afraid.

How many hours are you contracted to work each week? What days do you normally work? When did your sick note run from and to?

In the previous 8 weeks before you went off sick (so the past two payrolls) you need to earn a minimum of £109 per week before tax and NI to qualify for SSP. If you don't meet that criteria then the wages dept should send you a form SSP1 which you use to claim any benefits you are entitled to.

If you are going round in circles, and no one is giving a straight answer, I would advise you to contact ACAS to get some advice and help on what to do

i am contracted to work 18 hours per week, until recently this has been monday, wednesday and thursday, however it has been slightly varied some weeks.

my sickline ran from november 13th (wed) to november 29th (fri). i returned to work on saturday 30th novemver.

i have earned over £109 each week and have checked that on the HMRC website.

i have never been issued with any form regarding my time off other than the "back to work" form i filled out with my supervisor the day i returned.

they have said they only owe me for 8 hours and it will be added onto my next wage.

does that make things a bit clearer?

Sounds like you should be entitled to SSP at least. You mention company sick pay but without knowing the terms and condition for that we can't advise.
Here's the HMRC guide to SSP which is helpful. Also you can work out what SSP you are entitled to with this SSP calculator
