Is it wise to TTC with new job?

I'm starting a new job soon with a probation period of 6 months.

I've been TTC for a year, and have just been referred by NHS for fertility assessment. I've stopped trying this month (because I was made redundant so was too stressed to try).

When would be a good time to start trying again? I'm worried they'll sack me because I am pregnant during probation. It's six months so there's no way I won't be showing if I got pregnant this month, as I'll be 5 months along! Am I silly to wait for a few months so I'd be at most 3 months when I pass probation?

I need someone to slap some sense into me.

PS. I really need the job. At the same time I really want to be pregnant. I'm nearly 40 so I'm kind of desperate!

They can't sack you for getting pregnant.

The only thing you need to check before making your decision is if you will qualify for any enhanced maternity pay, if so they often say you need to have been there a particular length of time before you qualify, but you will still get SMP either way :)

But how do I prove they let me go because of my pregnancy? And not that I was incompetent? (It's my word vs their word isn't it)? I assume I should be proactive and ask for more assessment of my progress and then I can use that as proof that I'm doing ok?

The company doesn't have enhanced maternity pay anyway!

They would have to evidence why they let you go. So basically if you had all negative one to ones, poor performance etc then they can let you go, but they need to be able to prove it wasn't linked to your pregnancy.

They can let you go in the first two years without any comeback TBH.

Rockchick1984 · 03/12/2013 22:09

See here its discrimination if they do...

UnexpectedItemInShaggingArea · 03/12/2013 22:14

Yes, I know about maternity discrimination. In the first two years of employment they can let go anyone Go and there is no recourse to an employment tribunal. You would have to prove it was discrimination which is tough.

I would wait until you are comfortable in your new role and have established a reputation before trying.

Because everything is harder with nausea, exhaustion and worry. Because they can let you go when at your most vulnerable.

unexpected thanks for the heads up about unfair dismissal and the employment tribunal. I found
www.gov.uk/dismissal/what-to-do-if-youre-dismissed
Which confirms your 2 years figure. Basically the probation period is just related to my contractual notice period it seems. I always thought once you pass probation they can't dismiss you without reason. But the direct gov website then says I can't claim at the tribunal until after 2years anyway! It doesn't even mention probation period.

There is no way I can wait two years. HoleyGhost I think I will take your advice on getting comfortable with the job first.

They can't dismiss you for pregnancy at any point of your employment, the problem is that they can find some other made up reason to dismiss you, and it's down to you to prove the reason.
You will have other jobs, you may not have another chance at having a child. Good luck Thanks
