Hi started working for a care home in September ,full time 3 12 hour shifts a week

Since I started I had 2 days off with whiplash after a car accident ( went to work but had to go home as it developed )

2 days off because my dd fell off her horse and got knocked unconscious

A week after that i slipped on some water on a patients room had a massive bruise but no time off

Last week leaving work and slipped on a leaf it was wet dark and leaves on path knocked myself out , got concussion and had 2 days off and also tore the ligaments. In my knee but meant to be in work tue but won't be back

I just called and said I should be back next Monday but I'm going to the dr for a note this week
Scared they will sack me

You can't be sacked for having accidents.

You sound very unlucky op!

I am I'm the most clumsiest accident prone person I fell over nothing and dislocated my shoulder x

You can't be sacked for having accidents but many employers do manage attendance. 3 instances of absence in less than a year could be considered quite a lot (where I work, this could trigger a disciplinary investigation / action - incredibly unlikely to lead to dismissal unless there were other issues. More likely a first written warning).

However, the accidents that happened at work should definitely be logged as H&S issues. (the slip on water definitely sounds like its in this category - if the slip outside was on the premises - like in the car park - this would also count. If it happened, say on the street, it is unlikely to count as a work issue). A slip/trip/fall that happens at work resulting in 3 or more days off is a Reportable Accident - with a couple of days off, it should really still be logged as a Near Miss. The point of this is to investigate the causes to improve the safety of the workplace. In my experience, if you'd been absent resulting from a H&S issue, this would be unlikely to "count" as an absence instance for attendance management.

Yes it was on the. Work premises and my boss did say he was sorry because it was unswept and badly lit

Did they log it?

Huskylover1969 · 17/11/2013 19:15

Yeah they rang and asked all about it and said they were reporting it

You've only been there two months. They could certainly sack you if they wanted, and it doesn't matter whether absence relating to an accident "counts" for absence management or not.

You can't claim unfair dismissal for the first two years of employment. The only thing that might help you is that you are protected if you are sacked because you raised a health and safety concern, but I'm not sure that would be the case here anyway.

If you are a good employee hopefully they'll realise that none of this was avoidable and won't dismiss you. It would be a pain having to re-recruit anyway, so if everything else is good, I don't think they'll dismiss you.

maybe you need to consider getting some better shoes if you are so prone to slipping?

They can't sack you for having accidents, and as pp says, if you are good at the job it is very unlikely anyhow... make sure the time off for accidents at work are logged as such and not as "sick" days though....
