Can an employer call an employee into work for a disciplinary...

...while said employee is off sick with work related stress? DP had an accident at work in August and has been off work since, he went back last week but was only allowed to stay in the office (he works on the roads, he's never done indoor work in his life!) as work were investigating his accident and trying to find out whether it was his fault or not. After a week and a half of doing photocopying he finally had enough and asked his boss to being him home and the same day he got a sick note for stress at work. Today he gets a letter, asking him to go in on Friday so work can bollock him about all the things he's accused of.

A couple of people have told DP that calling him in for a disciplinary is illegal while he's off sick, is this correct?

It sounds as if those questions are not aimed at blaming dh - the issues aren't all (if any) in his area of responsibility. It sounds more as if he is a witness being questioned so that they can ascertain what went wrong.

His answers should be factual and brief and he should be very clear about what was, and what wasn't, his responsibility.

It sounds as though he has plenty to say, and he should say it.

Getting signed off with stress because he is worried about what will happen will look to them as though he is under the false impression they can't proceed if he is off sick and is trying to avoid being disciplined.

If he's stressed because he's worried about what will happen that's not going to go away, so if he can possibly manage to go to the meeting and say what you've said here, and what others have helped point out, that's the best thing he can do.

Well, he got his letter today telling him what he's going to be disciplined for, the only things he's not in trouble for is his colleague throwing cones off the van and jumping down off the van. So everything else on the list I wrote you, is what he will be getting disciplined for. Bunch of fucking cunts. They just keep changing the goalposts! The abrasive wheel training certificate he found dated 2009 should still be in date, apparently they last for 5 years, they are now saying it only lasts 3 years Hmm there's a few other things too.
