Accrued holiday pay - should I not be paid this on leaving my job?

Hi,

A little advice please...

I am on maternity leave and start a new job, at a new company, next week.

I resigned from my job 4 weeks ago, with my last day in that employment being tomorrow. I had been on maternity leave since the start of the year and this week was week 39 for SMP purposes. I received my payslip & P45 this morning and note that while they have correctly paid me my final SMP installment, they have not included any sum for the holidays that I will have accrued for the past 9 months.

Is this correct? If I'm due to be paid for my accrued holidays it's just short of £1,000 so I wanted to check!

Hmm, its not allowed to be paid with smp so that bit is correct, but they do need to pay it on your leaving. They should have worked it out and paid it after the final wk39 smp but before processing your P45.

Have a word, it can be a little complicated and someone may have just got it wrong.

You are entitled to it as pay if you haven't taken it as leave.

Yes you need to query it , when I left my job after maternity I also got paid for all holidays accrued

Hi Thanks that's what I thought.

The gross pay figure on my P45 is the same as the 'to date' gross figure on my payslip indicating that they don't realise that I'm due any accrued holiday pay.

Any ideas how best to query this? It's a small family company and I want to leave on good terms.

I see that you haven't had an answer, I would imagine that if it's a small company they either don't realise you are entitled or are choosing not to pay it. Giving them the benefit of the doubt and knowing that there are limitations to what can be paid when I would simply call and follow up with an email (or just email) asking if your holiday pay gas been overlooked, state in the email what you have calculated you are due.
