Sick leave fit note dates

I am on long term sick and had a fit note from hospital that ended on friday 21/09/13. My GP has given me a fit note dated yesterday 23/09/13 for 1 further month.Yesterday was the earliest day I could ask for this.

I had this taken into work and have now received a call from my manager stating that this will not do as there are 2 days missing from the dates. I am still suffering from the same illness . Do I have to contact my gp to get yet another fit note? He will not be best pleased.

Sorry do you mean you sick note ended on Friday 20th or Saturday 21st? If latter it's the weekend and don't know if it counts if you don't normally work weekends. Someone else might know.

Sorry .I keep doing this every time I mention the date for some reason.Confused

The old med cert ended on Friday 20th and the new med cert was dated 23rd.

I dont work weekends.

It's worth asking your GP if they can back date as otherwise you were technically fit for work for two days.

the fact I dont work weekends has no bearing on fit note dates?

And its not just my companys HR going into hyperdrive?

I can call my GP no problem but I just think is a huge faff for an ongoing illness.

I don't understand. Why do they need to know whether you were fit to work on a day you weren't due to work anyway? Your doctor started the note from 23rd because that was the next day you were due to work. If you weren't supposed to work anyway it makes no difference to anything whether you were fit or not. For the purposes of SSP this would be a continuous illness. All the days you were due to work are covered by a medical note.

flowery Thats my GPs take on it and really I suppose thats what i thought too. Although Im still on employers sick pay which might make a difference.

What does the policy say? Can't see how it should make a difference as you are not receiving or claiming any sick pay, SSP or employers sick pay, for the days they are concerned about.

Im not at work so dont have access to the policy or hr information.But my manager is insisting I get a cert to cover the 2 non working days and my GP is resistant to this.

I agree with the GP and think my manager is being a twat (yet again) and is parroting policy that she hasnt actually read and digested .I will press for the cert and send it in just to keep her happy. But I will hold it against her for general twattishness. Wink

As far as I'm aware if your sick notes don't follow on eg finish on 20th then next not til 23rd it would look like a 2nd episode of sickness rather than one longer one.

This affects pay and sickness percentages.

I agree both that the employer is being "jobsworth" about things, but also that it may count as two episodes of sick leave on your record which could be a problem if you have to have any further sick leave (even though it sounds stupid). What you're having to do is a waste of time for you, the GP and your employer, but I can see why they're doing it. The GP can only backdate the note if he has enough information to know that you weren't fit for work before he'd seen you, for example information from the hospital that makes this clear. S/he's not permitted to backdate a note unless they have this information.

Sorry but unfortunately your Manager is correct (and probably delighted to have something to pull you up on, by the sound of it!!), it is very important for Fit Note dates not to have a break as this can affect your sick record and pay, even if not scheduled to work those days. Your GP should also know this, as it is written in the official guidance on Fit Notes too.

I did get the fit note for 2 days in the end .The GP was not happy but if it is in the guidance then perhaps he should have known this without being asked.

I was half expecting yet another call from her asking about its whereabouts as she manages to call me at least twice a week wittering on about some random thing I have no interest in( her mothers kitchen for example - we are not work friends)Hmm. She didnt call so Im safe for another few days Grin
