Holidays for term time only staff

I work term time only and currently get 15 days paid annual leave
Which I take during term time now my boss wants to remove this as I'm not at work all year round! Can they do this as I'm finding it difficult to find out what I'm legally entitled to. I work 38 hours per week 39 weeks a year

It is usual for term-time staff to not be able to take holiday in term-time, I'm surprised you've been allowed to do this.

Yes term time staff are usually expected to take their holiday entitlement outside term time, that's pretty standard.

I work term-time = 38 weeks per year, but I am paid for 43 weeks which includes 5 weeks paid holiday, which means that 5 of my 14 weeks off are paid holidays. How is you pay calculated? I have never heard of anyone on a term-time contract getting holidays on top of that!

as far as I am aware they can give you notice of three months and change your contract, can you go to your union for advise? Is this happening to other workers with term time only contracts?

I work in a nursery which is open all year round but I only work 39 weeks of this. My pay is calculated by weekly amount x39weeks but divided by 12 months so I'm paid all year round, but if they remove my 15 days holiday I'm then not getting any paid annual leave as I don't get paid for the 13weeks I don't work!! Sorry if this is confusing if I'm not entitled to the extra days holiday then so be it I'm just struggling to find out!!

This explains how to calculate holiday entitlement for term time workers.

Typically employers pay you for the extra weeks of holiday in your pay (so 39 weeks work + x weeks holiday / 12) and the holiday is effectively taken during the school holidays so you don't get the days off during the 39 weeks.

I employ 8 term time only staff and calculate as follows

39(hourly rate)(hours per week)*1.1207

12.07% is what 28 days per year for full time staff is equivalent to.

I then take off the monetary value of any bank holidays or inset days or other non-work days that fall during the 39 weeks (effectively treating them as paid holiday).

Whatever is left gets divided by 12 and paid each month.
