Maternity leave pay - should be same as last time despite policy??

In my work place you only receive the statutory pay entitlement. They do not pay your salary.
However when I had my first mat leave in 2011 I was in a good position and negotiated for them to pay me 3 months' salary.
since i came back to work after the first mat leave (early 2012), I have been completely sidelined and essentially demoted, doing jobs I did 4 years ago. I am pg again and have no leverage to request to be paid 3 months salary (although of course this time i really need it!!) :(

My question: Do you think I have a "legitimate expectation" to be paid 3 months slary agan?

I would also point out that (1) I have received no salary increase or bonus since I announced my pg in 2011 (although in the 6 years prior i did very well every year) and (2) you would not believe the male-dominated macho "women are less valuable and once you have babies thats all youre good for" attitude in here. To even get what i got last time will be a huge battle. I will be coming back full time and plan to stay here for a few more years.

Do you have the negotiation in writing?

If not then legally they are under no obligation to pay this enhanced leave to you again as it could be viewed as a good will feature on their part.

Doesn't matter if the previous negotiation was in writing or not.

If the policy is and has always been statutory only, there is no reason to think that because you negotiated something else on an individual basis last time that has now become contractual.

Oh god. I know you're right. Just feel sick in my stomach as we only have 2 months living saved up and dp unemployed for past year so wont really be able to save up anymore. Never told them dp was out of work as none of their business. You wouldn't believe what jerks they are in there.

Omri, if it's such an awful place, why are you planning to stay for a few years after you return from ML?
