Part time holiday

I've recently gone back to work part time and I'm struggling to get my head around the holiday entitlement.

On my previous full time contract it stated that I had 22 days annual leave plus 8 bank holidays so 30 days in total. That was for a 38.75 hour week over 5 days.

Now I work 15 hours a week over 3 days. My employer is saying I have 18 days annual leave but I have to take 8 days out of this for bank holidays. I won't often be working a bank holiday so why do I need to take this as holiday? My days are Tuesday, Wednesday, Thursday.

We also have a Christmas shutdown which I need to save up to 6 days annual leave for depending on where the Bank Holidays fall. I could end up with 4 days annual leave! Surely this isn't right?!

Will be grateful for any advice.

I think this is right. Full timers get 30 days, or 232.5 hours holiday.

You are working 38.7% of a full timers week, therefore you get the holidays pro rata'd, so 90 hours. As you work 5 hours a day, this is the equivalent of 18 days work to you.

Sorry - didn't finish. As you don't work on Mon or Fri, the bank hol hours are added to your allowance. But you will need to use them to take leave over the festive season. Does this make sense?

So the August bank holiday just gone, I was deducted a day annual leave but I was never meant to be working anyway. Do you mean I shouldn't be deducted? But if the bank holiday was on a Tues, Weds, or Thurs I would be?

I have to book bh as leave, but yes you are correct you only need to deduct it if you took it. So you should have 22 days -max of three days for Xmas boxing and new year, depending when they fall, so this year you will loose 3, but next year 2. Some people find working out part time really confusing. If you worked Monday you would be worse off, but you don't so no worries there

Try looking on directgov although it only talks about statutory entitlements.

My understanding is they dont have to include bh but they obviously they can't make you take holiday on days you don't work.

We have a form at work but it basically just says pro rata the allowance and then book any bh as a/l. So basically you just need to take leave anytime you don't work 3 days regardless of reason.

The definition of annual leave is paid time off. You can't have time off on a day when you wouldn't be working anyway.

It makes perfect sense to me but he is adamant that I am wrong. He keeps saying that he gives us 2 extra days that he doesn't have to (30 days instead of 28). When I say that part time workers are entitled to the same benefits as full time workers but on a pro rata basis he tells me that he's already giving us more than he should!

He confuses me when I ask about it which is why I asked here.

You are entitled to 18 paid days off. 18 days where you would otherwise be at work, don't have to come in, and are paid as normal anyway.

Saying you were "on holiday" on a day when you were not supposed to be working anyway would be like saying F/T workers must take "holiday" on a Saturday.
