Redundancy likely - Company taking us over unlikely to do consultation

Hi

The company I work for is being taken over and this is likely to result in 20+ people being made redundant in the UK.

I know that legally the company is meant to go through consultation, but I've heard that they are unlikely to do so, but will offer a compromise. If they do offer a compromise, does anyone know what form this is likely to take - I'm guessing additional money?

If you are right they will offer a compromise agreement. In essence this means they agree to pay you some money in return for which you agree not to take them to an employment tribunal. There may also be other terms, e.g. to stop you from saying bad things about them and to make sure they give you an acceptable reference.

A compromise agreement is only binding on you if you receive proper independent legal advice. It is therefore normal for the employer to pay your reasonable legal costs.

Hi Minky

The offer should include compensation for at least the 30 days (or 45 if it is 100 or at risk) they should consult with you. Plus your notice pay. Of course if they want you to sign away all your employment rights you would want more than that. Also if they takeover the company they should consult under TUPE regs. You might want to ask compensation for that if they don't consult about the takeover.
