Repaying holiday taken when leaving job

On behalf of a friend. He is leaving his job and has taken 7 days holiday this financial year. The company are telling him her has only accrued 5 days before leaving so they will take the extra 2 days out of his final pay. Is this normal practice?

it'll ne in part of his contract, he can't take holidays he didn't earn

Yes absolutely. Should be outlined in his contract or handbook but if leaving employment you are only entitled to holiday you've accrued up to that point, so if you've taken more, it would usually be deducted from final salary.

If it isn't in the contract or terms of employment they can't take the money back as it is an unlawful deduction from wages.

I would imagine they'd class this as an overpayment higgle, therefore deduction wouldn't be unlawful.

The accrual period should include the notice period though .
