Please help - unfair treatment and carrier destroyed

My husband it seems is being sacked for team errors. All blame on him.

He went to work after trip to italy and had a meeting with boss outside office, which is odd.

He shouted and did not listen to what he had to say at all!

He said next week the director will speak to him. He didn't mention it was going to be a disciplinary meeting but gave him impression he is going to be sacked.

He worked there without any work issues for 16 years. Had review 1 month ago where he was praised. Now he becomes the fall guy for the team errors.

Do they have to say officially in advance it is a disciplinary hearing?

Can they sack him on Monday?

It would destroy his carrier and we would loose house as me as we'll I was made redundant after 11 years in one job.

I feel sick, not eating not sleeping.

Please please help.

No they can't sack him on Monday. He has to be given advance warning of a disciplinary hearing, including details of the allegations so he can prepare a defence, and must be given the opportunity to bring a colleague or trade union rep with him.

What was said that gave the impression he was going to be sacked? Indicating that a decision has already been made without giving your DH the opportunity to defend himself at a hearing is also dodgy.

He had absolutely no chance to bring a word in.
My husband has asked today his boss if yesterday was on official meeting and he said no, personal meeting....

Also it seems that employees have been instructed not to talk to him.
His indirect remarks gave him impression he is going to be sacked.

Thank u for your reply I appreciate. Just being able to just talk... Thank you so much

Does the employer have to give first a list with all accusations and then after he can take his stand?

:)

Yes if it's a disciplinary and his job is at risk he must be told in advance of what the allegations are. Otherwise he can't prepare a defence and a dismissal would be unfair.

Thank you flowery! Trust you are well and many blessings to you for your kindness and for sharing your valuable knowledge.

The boss who spoke to him yesterday is saying today that it was a personal chat and not official and he should write a letter for his mistake accepting responsibility and to blame anyone else...

He did do a misjudgement which he is prepared to take the blame but not everything else.

All this iis very odd..

As flowery says, any dismissal would be unfair if he hasn't been given notice of the allegations against him and provided with any evidence etc.

I would caution against him putting anything in writing accepting responsibility for errors. What sort of errors is he supposed to be accepting responsibility for?

jaabaar · 29/05/2013 20:22

Virgil it is a very big story. I wish I could write here but they might recognise the details.

So first he must be told that it is a disciplinary and if he has one they must present the allegations and then he has to reply to them there and then?

If he has been told there is a meeting next week that would be just a normal meeting where they discuss it? And can they after this meeting call for a disciplinary hearing?

Thanks again

He hasn't got to reply there and then-he must be told in advance of the hearing so he has time to prepare what he will say in his defence.

If any meeting is going to be a disciplinary hearing he must be told in advance. So on that basis Monday's meeting is not a disciplinary hearing, but yes they could call one after that if they feel its appropriate.
