late pay and incurring bank charges.

Hi, hope you can help...

I've recently handed in my notice but before that I was off sick with depression for 3 Weeks. The company i've worked nearly 9 years for have not paid me SSP since i've been off. I get paid weekly. I've had direct debits returned so have incurred charges for them and also extra charges from my insurance company.

I'm so sick with worry as the new company I work for pays monthly and I have to work a month in hand so I won't receive any money until the end of June.

I've just checked my wage slip online and my old company have only paid me 102 pounds. There is no explanation as to why i'm only getting this amount. This doesn't cover my direct debits or the charges (or the fact I've had to lend money from my family for a bus ticket to get to work).

I'm sorry if i'm not making much sense. I'm upset and my mind is all over the place. My car insurance Co have told me if I don't pay within 14 days they are canceling my policy.

My question is, can I claim back back charges and late payment fees from my old employer? For weeks they've been promising it would be paid in on Friday, then the following Friday. It's finally going in this Friday but not the amount I was expecting! I really don't know what to do :(

Have you earnt enough in the weeks before to be paid ssp. Can't do links on my iPad but think its about £100 a week for 8 weeks before.

When you say "there's no explanation", I assume you've rung and asked? Did they just refuse to explain your pay to you?

There is a calculator here to work out how much you should have received.

In terms of claiming charges incurred, that's not something you are legally entitled to do as such. Technically, not paying you on time may be a breach of contract, so technically you may be able to sue them for that and may be awarded damages in line with the losses you've incurred as a result of their breach.

In reality that's a big hassle. Morally they should certainly reimburse you for charges incurred.

Work out how much you should have had, then press them for a breakdown of your pay, assuming you've not received what you should have done, and also ask for charges to be reimbursed.

I assume you've told your manager this? Is he/she being helpful about it and badgering payroll for you?

Did you submit medical confirmation of the fact that you were sick? This is the most common reason for non payment of SSP.

Basically you won't get anything for the first 3 or 4 days, then (assuming you are full time / earn enough £86.70 per week. You only get this if you give them a sick notice within 7 days if I recall. You have to have a new sick note in place before the old one runs out as well.
