Hi

Ive just recieved Job Offer in the post for new job starting in March

I will be working 3 days a week. The way they have detailed my pay structure is very bizarre - they say that I wont be getting holidays but will be getting more a day to reflect this.

Is this a good thing or not? Surely this means that Ill earn more a month than I would if it was just pro rataed with holidays included so then could end up with less working family tax credits etc and if I do need to take holidays I wont be paid for the days I do?

That I would say is bad. Part time workers are entitled to the same holiday rights as full time workers. Does that mean if you want to go on holiday it will be unpaid?

I think this is a little out of the ordinary - I would look into it a little deeper before accepting the offer. Sorry not much help.

This seems very strange to me too! Surely they have to give you a holiday entitlement?

I think this is bad, and you will be unpaid for any time off you take. I'd ask if you can be pro rataed and have a holiday entitlement.

Surely there must be a statutory minimum on holidays. I think you have summed it up in your last sentence and it sounds dodgy to me.

I work 3 days and get pro-rataed hols - if I was full time I would get 27 days but actually get 16.2 days (the 0.2 was decided two years ago at the discretion of my manager and means 1.5 hours which I used to take DS for his 2 year check rather than booking a full half day). It has since been decided that I should also get pro-rataed fixed Bank Hols. This means Good Fri, Easter Mon, May Day, Spring Bank Mon & August Bank. So because I work Tues-Thurs I get an extra 3 days to make up for these. Christmas/Boxing/New Year I get if they fall on working days _ ie sometimes, sometimes not. HTH and doesn't just confuse.

Higher Monthly Pay AS LONG AS NO HOLIDAYS TAKEN
the difference between what they are proposing and pro rataed is worth about 1.6 days holiday a month so any month I took more than that I would be down for that month - if I have worked it out correctly

I think it would probably be detrimental to help with childcare etc too

Hi Becca. Have you got a local CAB that might be able to advise you? I'm sure you have a legal entitlement to holiday and I'm not sure that can be waived by a higher daily rate. I mean, just because they say it's higher doesn't mean anything, does it? Surely if that was legal it would be open to abuse. I think check the situation before you think about accepting the job. Hope you get it sorted to your satisfaction!

In the UK, the Working Time Regulations set down a statutory minimum right to four weeks paid leave each year (once you have been continuously employed for 13 calendar weeks or more).

So if you work five days a week, the entitlement corresponds to 20 days annual leave - for you Becca, working three days per week, you would have the right to 12 days paid annual leave (this is a minimum it could be more depending upon your contract terms).

If you didn't have hols what would you do becca if your children had an appt/were sick? Suppose this depends on your childcare plans.

I don't think Bekka's employers are trying to stop her from having holidays(even if they were, she is legally entitled to them), I think that they are just saying that she will not be paid for any holidays as her 'holiday pay' is incorporated in her basic pay. A lot of employers in some sectors do this but the courts are undecided as to whether it is legal or whether holiday pay, by law, must be paid when the person takes the holiday.
