my husband is on a paternity leave ( till baby's first year), so does he have the right to request to go part time: 4 days instead of 5 days after PATErnity leave?

Yes, flexible working requests can be made by anyone who is the parent of a child under 16 Smile

I don't entirely understand your post, but as far as requesting flexible working goes, he has exactly the same rights as a woman does.

Is he on the shared portion of your maternity leave at the moment?

Hotpotatofood · 09/03/2013 21:41

yes, he is on a hsared portion of a maternity leave. in thye past we reqeusted working 4 LONGER days instead of 5, and this got accepted BUT only for 2 months 9 this was on a basis that my father had cancer in needed support. not sure, if we have 2 kids and my husband applies on the basis of caring for 2 under 5s - will he have more chance to get his request accepted?

So far as I'm aware, anyone with parental responsibility for a child has the right to request flexible working (which would include going part time), regardless of their gender.

The employer doesn't have to agree, but they'd have to give a good buisness reason for turning down the request.

Your husbands employer may have policies on applying for flexible working, if they don't the gov.uk site gives some info on rights to apply for flexible working.

yes, he has the right to request this.
DH requested 4 days/week (compressed hours) after dd1 was born, and his employer agreed. It worked really well, although due to relocation and a change of employer he no longer does this.

The chances of being accepted would be based on business need, not whether your DH has 2 children under 5 or 1 under 10 - the business wouldn't care about that tbh.

Your DH needs to put together a case for the hours he wants to work, how it would affect the business and/or other employees and what can be done to mitigate these effects - his manager will only care about whether it is going to affect him getting his job done so your DH needs to cover any potential issues that may be raised.

my husband's employer does not pay for lunch hour - can my husband say that he owuld work compressed hours and have lunch just 20 min?

He needs to focus on the business needs. For example, what will happen to his work on the day he doesn't work. As he has already worked a 4 day week, he could refer back to how it worked then, if it was successful.

Your request will need to comply with working time regulations in terms of breaks.Hmm
