Hiya everyone I have a probelm with work

a- I was on maternity leave and sick leave for pnd and then returned 5 weeks ago
Company had me on a rehabilitation programme
-My role was not performed by myself bcos the company said i had to train before i could work as my normal role as everything had to be fsa accredited. but theycouldnot allocate a training day for me so i sat doing junior duties for last few weeks .

I had no objectives or performance reviews as i was not able to complete my role instead i worked helping other team memebers gain targets in lending by solciting leads for them and sending 100;s letter out etc..Boring i tell u

Anyhow I was made to feel like a junior when prev to maternity i was a senior person in branch.

Recently my daughter was in hospital and the manager was aware he was harassing me and the team was treating me badly so under pressure i resigned , now i feel i resigned becasue i was not in sound mind at time emotianal daughter was in intensive care when i retracted the statewment the boss said he had already accepted it!!!!!I am lost the area amanger phoned me to say he was not getting involved with this whole issue and i needed to spk to line manager and ex area manager but they are being unfair,,,,have i got a case ,,another thing is ive not been paid properly and the boss said i was not entitled to annual hol leave as was on maternity and sick,,,,,what do i do ,,,im just working notice but angry they so un -compassionate

You ARE entitled to annual leave - you accrue it whilst on maternity leave.

You need to follow the grievance procedure that your company operates immediately - even though you have left. They are obliged to help you to do so. You MUST do this in order to lodge a complaint at tribunal if you wish to do so. You have 3 months from your date of leaving to do so.

It seems like you have a case for unfair dismissal (i know you resigned) and also for sex discrimination.

Would strongly recommend you also contact the CAB for advice asap.

its constructive dismassal so I think you need to consult a solicitor

Are you a member of a union? Contact them if so.

You can claim constructive dismissal (via a solicitor), but you cannot withdraw your resignation. The company forced you out by giving you inappropriate junior-level work, not setting objectives, failing to provide training. Then there is the harassment and possible sex discrimination.

But it is worth thinking what you want out of this. Once you have resigned, the company has no duty to take you back. Claiming compensation can be very distressing and long-winded. If you can find a solicitor who is a specialist in employment law (via The Law Society), it would be worth having a conversation. Do not just go to the local solicitor who does conveyancing most of the time.

you are legally entitled to withdraw your resignation within 7 days of submitting it. if you've left it longer than 7 days then you can't withdraw it.

wannaBe1974, that may be written into a specific contract, but is not a universal right.
