Im a nanny and was due to start full time position soon, the mum has decided her head is all over the place and doesn't want a nanny!!!! We both signed a contract two months ago stating that I was going to start working for them on a certain day and all i can say it that three days before start she rang and cancelled me like I was a babysitter!! Am I entitled to any notice from her? ( money or wages ect..)My contract states that within first weeks of employment both of us are due to give one weeks notice. I'm being vague because it's a delicate situation.
I'd left myself vacant for the job for two months and temped in the mean time, can I do her for loss of earnings?

I would have thought she'd have to pay you the weeks notice. I have no experience of this though.

Thanks that's what I thought as well but she refused to give it to me!

Legally I think that because your employment hadn't yet started she doesn't have to pay you notice? I hope flowery or someone who knows will be along

She is in breach of contract by not allowing you to start work so technically you could bring a claim for damages incurred as a result of the breach. Morally she's behaved incredibly badly as well, that's pretty shocking.

I don't know whether you'd actually want to go as far as bringing a claim, but you could write to her saying you've taken advice Wink and you understand she is in breach of contract and unless she pays you your week's notice you will be investigating your options for redress including bringing a claim in the small claims court.

I second flowery. You had a contract, she has breached it, you are entitled to claim for damages.
