I have a friend who is going to an industrial tribunal soon as she has been sacked from work.
The dept. she worked in was closed down and several staff were made redundant.
She was offered, what her employer considered to be "suitable alternative employment".
She turned this down on several grounds including working extremely unsociable hours (her previous post was 9-5pm, Monday to Friday), working weekends and bank holidays (she had these off in her previous post) and an increasingly stressful role.
All these factors she considered would have a negative impact on her family life.
She would have preferred to have been made redundant as her colleagues were but was refused that option.
She is representing herself at the tribunal.
Any advice you could give her?

These are extremely complicated. It will depend what's in her contract, what consultation they did, what other employees were prepared to do it. It will come down to what 3 strangers decide on the day was "reasonable". She really needs to take proper advice.

I took my previous employer to an employment tribunal. Yes it does all depend on what is deemed 'suitable' but your friend has a fair point and she should put ths forward, she has nothing to loose at this point. I represented myself, the tribunal panel consisted of a judge and two others. Each party puts forward their argument and the panel then asks questions. My advice would be to ensure a bundle of documents is produced in coronalogical order, of all the letters and documents that have passed between the two parties. This needs to be produced by one if the parties, the list of the contents should be agreed by both parties. Your friend should write a Statment of what as happened, I did mine like a list, in date order. Try and stick to the facts, no point in discussing past issues which are not relevant, this will just annoy the panel. If she is nervous she can go and sit in on a hearing to see what happens? I ate and slept my tribunal for almost two years and was so prepared on the day that I wiped thefloor with my ex-boss! Dont expect anything to happen quickly letters and hearing dated seem to take an age to get sorted! I would be more than happy to help your friend, if she has any questions please let me know
