leaving current job with no contract for new job

(Similar to a thread I just read, but not wanting to hijack..)

I was offered a job (same role, different county) earlier this month. My current contract stipulates 3 months notice (typical for role). I have signed a draft letter of acceptance, and have been offered a draft contract. The official job offer depends on 1) CRB 2) satisfactory references and 3) health questionnaire.

CRB has been applied for, but will take however long to get back (not online). Is it safe to resign my current post? I'm concerned that if I resign now, without a proper contract, the new employer still has the opportunity to pull the post. On the other hand, three months is a long notice period, and the new employer is getting antsy about setting a start date.

Any thoughts, wise MNers?

What is draft about it?

Are you just referring to the conditions!?

SophySinclair · 24/07/2012 20:50

well it says draft letter of acceptance on the letter and draft contract!

They have the opportunity to dismiss you at any point during the first two years, so waiting for a non-draft contract won't make any difference to how solid your new job is. The only thing you should be concerned about is whether there's a possiblity they may change the terms and conditions on the final contract, but that doesn't sound likely.

2 years ??! really???

Yes, you can't claim unfair dismissal now for the first two years, other than for some specific reasons, mainly to do with discrimination. So effectively they can dismiss you pretty easily until you've been there that long. It increased from one year to two in April.

actually can I ask another question... I work in academia which runs August - August. When I leave my current job, I will have about 20 days of annual leave left.

Does my current employer pay me for all 20 annual leave days not taken, or do they pay me pro-rata?

Thanks ladies!

Pro rata for holidays.

I would say the "draft" is a bit of a red herring.
