Help! Disciplinary procedures, dh thinks he's getting sacked tomorrow.

Dh has worked for company since winter 2010 and never had any issues.

Was sick for 2 weeks last oct caused by work related stress, had a meeting with management on return about putting things in place to help with workload, he trquested additionsl help, but although things were agreed in principle nothing was actioned (working from home once a fortnight, additional admin support etc)

In April he had 2 weeks off with chest infection which was diagnosed by hospital after chest X-rays, again, they suspected bought on by work related stress.

On his return a dossier had been out together about all issues that he had 'not done' had meeting with md put case forward, felt meeting went ok, but ultimately was told they werehfiving him a warning.

He's had another 2 weeks off, suspected clot on lung, bought on by work related stress and went back last week to be presented with another dossier of issues that pre-date last lot. And has told me it reads " if found guilty your contract will be terminated" now a lot if what has been used was a meeting with his manager which he thought was an informal chat about any on going problems, but this has now been minuted and used as basis.

I need to find out what the first warning was (first or final)

He works on the city and has said for the last few months it feels like they want get him off the payroll anyway possible. He has applied for other jobs but he is very specialised so jobs are few and far between. If he gets sacked he'll never be able to get another job in his field and is all ready to walk in and resign tomorrow so he jumps rather than gets pushed.

It's a small company, I've asked him to get disciplinary procedures but he's not sure if they have anything written down

Just to add to the issues, I'm 39 weeks preg and when they were discussing paternity leave with him
Last week, the md told him he couldn't take a week's leave as he hadn't accrued enough holiday so if baby came in July they wouldn't pay him but would have accrued it by end if August do would pay it to him then. It just feels like a kangaroo court where they are going through the process but decision is already made.

Any ideas how to proceed?

I seem to think there are more than 26 weeks between Autumn 2010 and now??

Sadly though it might well be a tribunal for you as to me it sounds like constructive dismissal even if he goes today.
Srry am not very knowledgable but good luck and good luck with the baby.

Sorry, think worded the paternity leave wrong.

He is entitled to the 2 weeks paternity leave at stat pay, however, because 1 weeks pl wouldn't cover a weeks train ticket for him, he wAnts to take 1 week paternity leave and tag a weeks annual leave on at the end. This is what they are saying he can't do at the moment and it's down to their discretion if they let him take it and pay him in this month (although at this rate it doesn't matter about that cause of baby comes tomorrow 1 week paternity will take him to end of July and then a weeks paid annual leave in August) its the pettiness of it that's getting to him and me
