Claiming smp from main employer whilst still working my part time job ?

I work a 38 hour week for a care company and 15 hours cleaning job for a Drs surgery. I can claim smp for the full time job but not for the 15 hour one as it is £97 a week so I wouldn't qualify. I have spoken to inland revenue on the phone and was told as long as I was employed 15 weeks before baby was due (I have worked there nrly 7) then yes I can work through whilst receiving smp for the other . There is also this statement on their website . But I can't help feeling I will have this baby then inland revenue will say no ?

HMRC are right, and their guidance agrees with that. As long as you were already working for both employers at 15 weeks before your due date you can go back to one while receiving SMP from the other.

Great just needed to know I'm not getting a longwinded letter from hmrc ! I have spoken to job centre an they have said to ask my employer whom is paying the smp but I don't see y I should have to really?

Job centre isn't the place to ask about SMP rules, and no you don't need to ask either employer.

Thanks so much flowery! So nice to find ppl on here whom have also heard of these rules instead of saying it is fraud when it is clear as day on at least 7 websites I've found including DWP . One more thing do I need to tell Inland revenue what I am doing as when I call I can't seem to find someone specific dealing with smp? Or do I just take it that when They pay the smp and see I'm still working my other job (after 4 weeks off ) that they know that is in the rule book.

No you don't need to specifically inform them at all. SMP is paid by employers so employees wouldn't have any need to speak to HMRC about it. If your employer thinks for any reason they shouldn't be paying you SMP they will have to speak to you and would query it direct with HMRC.

Similarly as you are obviously planning in going back to work sooner in your second job, you don't need to notify your first employer when you do that.

You can claim SMP for both jobs for the time you're on mat leave from both as well.
