Boss said the budget is spent...my job?

I took career break. I asked for extension of 2 yrs my boss agreed had letter via HR it said I may have to go back lower scale 10K less, this is policy.

Phoned my boss other day to say I will be back (3 months notice is stated but it's 4 months off returning so plenty of notice).

Boss said he was meaning to write to me 2 months ago to say as he had not heard from me, my position was no longer there. He thought he gave me 1 extra yr off only! I clarified 2 yrs as on letter. He said there was no more money left in budget!

I also asked for working term time only and he was
I have ds with ASD and no family/no childcare in all holidays.

He also asked was I fit to practice I said yes I checked with NMC and voluntary work counts. He said he will check it out.
Boss said for us to meet in 2 weeks. I am worried!
I work for NHS.
I am under 41yrs for redundency and I would have no payment as no pay in last 5 yrs? Is this right? Would they then offer me an alternative work postion?

phoned RCN and told because it is ongoing before I rejoin RCN they cannot attend/assist.

Would another Union help Unison etc?

Unison won't help if you are not a member.

You would need to check, I had some probs at work and was going to join but they would
not help with any issue that was already existing.

A union won't help you with a pre-existing issue if you're not already a member.

When you first had your career break agreed and/or when the extension was agreed, what did the letter/s (and career break policy if there is one) about returning. It would be perfectly usual for no guarantee to be given of a job being available when the individual wants to return.

I've no idea what your redundancy entitlements are as I imagine there are enhanced policies within the NHS so you'd need to read it.

Thanks flowery, it says they do keep a position but may be band lower (5) so like a new qualified pay eek!

It does not meant ion redundancy no where in letter.

I have 21 yrs service but that includes 5 yrs career break!

So I can join union for ie asking for child friendly hours as that will be new!

Op, I am by no means an expert but I'd try and keep the issues of flexi working and your existing role separate. You may undermine your request for returning as per your original agreement in asking to work term time only. I'd be wary of asking for that at the moment to be honest. It's bad if they are going back on your original agreement but you asking for term time only hours also looks bad- its not your works fault if you have child are issues and there are other options than family. Sorry not wanting to sound overly harsh but think carefully about this.

I would be worried that you are not able to be registered after a 5 year career break.

The NMC requires you to have "450 hours of registered practice in the previous three years". This can include some voluntary hours, however unless you were working the 450 voluntary hours as a registered nurse you would not be able to count it. The NMC do not count working as an HCA as registered practice, for example.

I would clarify this with the NMC because it sounds like your boss could argue that you don't meet the requirements.

I agree that you need to check your NMC registration requirements. Do you hold current registration?

Even if you are looking to return to the register, you will need to show that you have completed 750 hours of registered practice in the previous five years and 35 hours of learning activity in the last 3 years. If you were lapsed during the five years/not completing registered practice i.e. HCA as callow says, then you may find you need to complete a return to practice course. This will have implications for your return to employment.

Thanks callow and isneeyes. My registration is fine I have done way above hours and PREP also. It is the next 3 years from now I need 450hrs. I already checked with NMC 5 yrs ago the work I had to do voluntary. Been on lots of courses, read lots to do with field and done NVQ 3 (although this may not count but way above 5 days) giving a talk in couple days to Health Managers etc
