0.8 contract and bank holidays

Bayliss1 · 06/05/2012 19:22

I've just returned back to work as a primary school teacher, after maternity leave and have reduced my contract to 0.8. My day off is Monday (this was decided between myself and the headteacher/governors). This Monday is a bank holiday and some people have been asking me if I'm getting Tuesday off because I only work 0.8. Should I be getting Tuesday off as Monday is my normal day off or do I just work my 4 days as normal??? Not sure do wondered if anyone on here knows the answer???

As far as I know you are entitled to 0.8x as many bank holidays as a full time worker. I dont know how it works in schools though, in terms of leave when the school isnt shut.

missmapp · 06/05/2012 19:26

i work 0.8 and have fridays off ( am a primary teacher) when good friday is outside school hols I just miss out, Ive never thought I should get a day in lieu, so havnt officially checked it out, but I dont think it works like that!!

EnsignRo · 06/05/2012 19:26

I work 4 days with Friday off, and if the bank holiday falls on a Friday then I get 0.8 of a day back as lieu. HTH!

wonkylegs · 06/05/2012 19:27

It depends on the exact wording of your contract - dig it out and have a look.

GrossePopel · 06/05/2012 19:28

I work 0.6 WTE (NHS). I'm entitled to 0.6 bank holidays. Therefore every bank holiday I have to take 0.4 of a days annual leave.

GrossePopel · 06/05/2012 19:29

Oh that's because I can't and don't work bank holidays but do normally work a monday. Bloody complicated, took HR ages to figure it out.

cleanandclothed · 06/05/2012 19:35

I work 4 days a week with my day off as Monday. My contract says I have 5 weeks holiday (pro rated to 4 weeks) and 0.8 of the bank holidays (=6.4 bank holidays). As the majority of bank holidays are generally on a Monday (Easter Monday, and both May and the August ones are all Mondays, plus some of the others maybe depending on the year) I get extra holiday in lieu.

Eg suppose in one year there were 3 bank holidays that were not on a Monday, I would get an extra 3.4 days off.

However, it depends on your contract. Everyone is entitled to 28 days off a year if they work full time (so 22.4 days for a .8 contract). Assuming (as you are a teacher) you get more than that, it will depend on your contract to give you more.

ginmakesitallok · 09/05/2012 19:18

cleanandclothed - sorry but your post makes no sense to me! I work 3 days out of 5. So on top of my annual leave I get 3/5 * 8 days public holiday. When a public hol falls on a day I work I have to take a full day out of my leave entitlement to cover it (like Grosspopel) I don't understand how you can get extra hols when PH fall on days you work??

catsareevil · 09/05/2012 20:06

Do you own the company? You are part time, getting most bank holidays off, and then for the ones that you do work getting more than that back in A/L. Surely that makes you better off for bank holidays than the full time staff?

bigwombat · 09/05/2012 20:20

You are entitled to 0.8 of the bank holidays. So in a bank holiday Monday week, you accrue 0.8 of your daily working hours as holiday in addition to your normal holiday allocation. However, as someone said, you need to look in your contract as your annual holiday allowance may already have been adjusted to include your share of bank holidays. How much holiday does your contract actually state given you are a teacher? interested

Bayliss1 · 10/05/2012 19:45

I'm not sure what my contract says, I will take a look and get back to you.

No, perhaps I didn't explain very well. I am entitled to 6.4 bank holidays per year, as I work 0.8 of a contract.

So suppose a years bank holidays are:

Good Friday (friday)
Easter Monday (monday)
May (monday)
May (Monday)
August (monday)
Christmas Day (Tuesday)
Boxing Day (Wednesday)
NY (Tuesday).

I would have had 4 days off that year as 'normal' bank holidays. But I am entitled to 6.4, so I get an extra 2.4 that year.

On the ones that fall on a Monday, that is of no benefit to me as I don't work that day, it isn't the same as 'having them off' - I am not paid to work Mondays.

cleanandclothed · 10/05/2012 20:26

If, for example, I worked 0.8 of a contract with Friday as my day off, it would work the other way around - I would be entitled to 6.4 days but I would have had 7 - so I would need to take 0.6 days of annual leave (it would be deducted from my holiday allowance).

CharlotteBronteSaurus · 10/05/2012 20:28

i think you'll need to ask a fellow teacher
i work 0.5 WTE, so get 4 public holidays added to my A/L
when there is a public holiday on one of my working days, i must take A/L

but if you are a teacher, you don't have an A/L allowance as such, so I'm not sure how that would work.

GiraffesMum · 10/05/2012 20:36

As a ft teacher you're contracted to 1265 hours a yr, at the direction of your head teacher. Therefore as a pt teacher you are required to work 0.8x1265 hours (1,012). These will be used up working Mon - Thurs and attending meetings, parents evenings, etc. So in short, you don't get any more time off for bank holidays. Check your union website for guidance.

GiraffesMum · 10/05/2012 20:37

Oops - should be Tues - Fri in your case!

DonInKillerHeels · 10/05/2012 23:36

You should get extra time in lieu; this is what my PT admin assistant gets (she doesn't work on Mondays)

AngelEyes46 · 16/05/2012 23:21

I'm not sure if I agree totally with Giraffe. 1012 hours - yes. bank holidays - all the Mondays fall within school holidays except for 1- Mayday. So 1265 hours divided by 195 days = 6.48 hours per day. 80% of this is 5.18 so I think OP is entitled for additional payment. I would look in the pay terms and conditions.

Bayliss1 · 20/05/2012 11:17

Thanks for all your responses! I've still not got around to looking at my contract due to illness!! Will report back when I do! Smile

I'm having issues with my boss about my annual leave entitlement (I worked M,T until mid April, M, T, W after)
The calculation used by my nursery is:
20 days holiday, add on 8 BH (9 this year),
Multiply by PT factor (0.6 or 0.8 in my case), then take off all bank holidays that fall on a work day (in my case 7).
In your case it should be:
(20+9)*0.8 - 3=20.2 days. Check your contract whether that is rounded up or down, whether part days count, and what happens with BH outside term time as you are in teaching.
