Quick question regarding Holiday Pay when leaving your employer

Just after a bit of advice on behalf of my Brother please..........

He is going to hand his notice in tomorrow.

He works for a large, family run firm. He has been employed by them for 9 years and over the last couple of years he's been treated terribly. My Brother is only 25.

Anyway, his annual leave at work runs from April 1st - April 1st. He hasn't taken any holidays yet and has none booked.

Should he be paid his holiday pay in his final wage packet? Or would it be pro rata or his full entitlement? Or any at all?

Any help would be great thanks.

Any holiday accrued but not taken at the termination date should be paid in lieu.

He should get a pro rata sum in his final wage packet but it won't be much if the holiday period started from !st April.

Assuming he has a months notice period it will be about 4 day. They should round it up.

Unless he works part time the legal minimum is 28 days a year.

He works 7.30am til5 pm mon to fri.

Occasional Saturday. He's a design engineer for coach builders if that makes any difference?

Is that 28 minimum not including 8 statutory bank holidays flowery? And he will have had 2 BH in April for Easter and will have May Day next week too.

It's 28 including public holidays, so pro-rate that down from 1st Apr to end of notice period, deduct the public holidays and the difference is to either be taken or paid.

The 28 days can include bank holidays, yes roisin. I have no idea whether the OPs brother gets bank holidays off as part of his entitlement or not.

Either way, it should be calculated as Ellypoo describes - working out how much he's accrued, deducting any he's taken and paying him the difference or getting him to take it during his notice period.
