A friend of my oldest dd (22) has asked me for some advice . I know bits of employment law but am a bit stuck. BAsiclally, she has returned part time to work in a chain restaurant/club - after being on maternity leave. She works 12 hours a week, signed a contract initially when she started two years ago, but nothing on her return. She says the manager is treating her badly, giving her difficult shifts, keeping her late, accusing her of stealing tips etc. She's also saying that one of the bosses has 'come on to her' and she told him where to go at which he started making things v unpleasant. She wants to leave and make a complaint but doesn't really know how to go about it. I asked if she had seen their policies and procedures etc but she doessn't think they have any (?) At least she has never been made aware of them. I feel she needs some proper advice. Can anyone give me a starting point? As I say, i do know a bit about employment law, but not really enough....!

This sounds like harassment and she has the right to raise a grievance, which her employer is legally obliged to investigate. If it's a large company they probably have a HR department, who should be her first port of call and they should be able to explain the company's grievance procedure to her. Even if there's no HR department, she should put her grievances in writing and send them to a senior manager. She needs to focus on facts - what was said/done, dates etc. It would be helpful for her to keep a diary of any incidents that occur, as this will help to support her case if it's one person's word against another.

I would also suggest that she contacts ACAS (www.acas.co.uk).
