Filling out online forms to register as self employed and have a couple of questions....

Im hoping someone can help.

I have to register as self employed as my 'employer' isnt PAYE registered.

I am in the process of filling the forms out online. I started working there last jan 2011. Was only working 11 hrs a week so never paid tax or NI. I sept 2011 I then took on more hours to make it up to 22hrs. At the beginning of the yr my employer said I should be registered as self employed...........

So filling the forms out, do I say I started working in jan 2011 or when I started more hours in sept 2011? Also there is no mention of how much I earn as I dont earn enough to pay tax.

One more question is in the next few months I am going to do childminding so how do I add this on to my buisness?

You need to go onto the HMRC website and start with employed or self-employed?. HMRC were clamping down strongly on employers making people be s/e when they arent.

In that section is a number you can call who can answer those questions. If you have a second job as a childminder you just get 2 separate lots of self employed pages to fill in - one for each business.

There is a fine for registering late .... so unofficially make the date as recent as possible.
You say you do not earn enough to pay tax. What about other sources of income? Would you have been eligible for tax credits if you had been legit?

Boringly I am going to suggest that you post on the UK Business forms with a few numbers and exact info

but there are REALLY expert people who can help you make the decision.

Basically your "employer" is taking the &&&& - you are an employee and they are avoiding their legal duties, BUT its best if you go squeaky clean so that if you ever get investigated the odure hits their fan not yours.

If you describe your business as childcare then it will cover all your options :-)

In your situation (I have seen some of your other posts) the best thing to do would be to call the Newly Self Employed Helpline and explain everything.

my instinct is that the OP needs to engineer a PAYE visit - it will be interesting to see what UKBF say
the last one of those I did was a bloodbath and everybody got fired (scaffolding, no insurance, box ticked) BUT the employees who'd flagged clearly were marked as they had NO problems later
what is your moral view on what OP faces - regardless of the industry which IMHO makes is utterly worse (for her employer not her of course)

I agree. The Newly Self-employed Helpline is usually staffed by people that have a basic understanding of employment status issues, and an awareness of trades where false self-employment is and always has been rife - construction and childcare/domestic services being the top two I believe. I would hope that they will not let the OP register as she is not in business but will pass the details on internally.

I try not to get involved in moral discussions - not in public anyway Grin

Hi and thanks for your replies. what happens then if i just submit the online forms to HMRC and put childcare in the description of work?

Yes we are all CRB checked and she has apropriate insurance.
