I am on mater ity leave and looking for a new job and wondered what would happen in the following situation.....notice given and due to return to work beginning of June (this is when my paid leave would finish) and have to give 4 weeks notice if I resign so what happens if I hand my notice in whilst still on leave and my new job wants me to start straight away? Can I do that?

Not sure about the specific question. Worth checking the terms of your maternity leave if your employer gives you a better-than-statutory deal, eg full/higher pay for several months. You may have signed a commitment to repay some of any additional pay if you don't return to work.

You can't really start your new job while you are in your notice period for your old job, but your employer will probably release you early if you ask them as it will make little difference to them.

Thanks.

I don't get any addition Pay etc so that's not an issue.

Re the notice, basically - I won't be returning if I were still there until June however if I get this other job I would need to start earlier. Could I just do tge 3 days training there as kit days even if I have changed employer?

Yes, as long as your employer is happy to release you early

So I would need to leave with immediate effect basically. My line manager wouldn't be a problem just wonder about tge higher beings.

What happens if they insist on notice and I start somewhere else?

Anyone?

Realistically probably not an awful lot, although it might make getting a decent reference from them in future problematic.

But if you're not in the office already and confirm you are not coming back, there's no reason for them not to release you early anyway. As I said earlier, it makes little if any difference to them.

Thanks flowery, tge pressure has been lifted a little as my interview has been put back so think it will be easier to work out although may still have to request to leave early as don't want to leave till I have another job secured.
