My employer has just issued advice stating that part timers won't get any enhanced overtime on a Sunday or bank holiday unless they have worked over 'standard' full time hours (36) that week.
I'm going to send the response below, does it look ok?
"The policy states that employees must:
Complete the Overtime Claim Form where payment for overtime in excess of 36 hours per week has been authorised
Complete the Additional Hours Claim Form where payment for additional hours for part-time staff has been authorised
My understanding is that you cannot complete the ?Overtime Claim Form? until you have worked over 36 hours, and overtime payments then apply. Until you reach 36 hours you must complete the ?Additional Hours Claim Form?. This form states that ?Additional hours are paid at plain time rates Mon ? Friday, and plain time plus week-end enhancement for additional hours worked on Sat ? Sun?.
This would be in compliance with businesslink.gov.uk advice that:
?Compared with full-time workers, part-time workers should receive equal:
Rates of pay - part-time workers must receive the same rate of pay as full-time workers carrying out work of equal value.
Overtime pay - but only once they have worked more than the normal full-time hours of a comparable full-time worker
Enhanced rates of pay - for working outside normal contractual hours, eg bonus pay, shift allowances, unsocial hours payments and weekend payments.? "
