Redundancy Payment - is this right?

Morning, just wondering if someone with employment knowledge could advise me before I enquire with our HR.

We have all been offered VR in our department and I think I'm going to go for it. I've been there almost 24 years and the payout isn't bad.

However, currently I work 4 days a week and the payment is based on xxx weeks per year worked, multiplied by my salary - which is the pro-rated amount.

Given that some 17 years of those 24 were full time (before ML and DD), shouldn't it be on the 'full' salary figure for those weeks?

It won't make an enormous difference and if it's correct, fair enough, but it doesn't seem morally right that they get to base every year's worth of payment on my part time salary and not at least some on the f/t 'base' (which is what everything else associated with my job has ever been worked out on).

If anyone could advise I'd be very grateful :)

It's not like a pension. Your "current" job your being made redundant from not the one you held a few years ago. It's based on current T&Cs.

No, it's based on your current salary.

Redundancy is based on the job you are doing at the time, so your part time salary.

Think of it as compensation for loss of future earnings, it makes more sense that way.

I just wanted to add, I'm no expert but, when we were being made redundant from a company 10yrs ago one lady I worked with had just returned to work from mat leave on a part time basis. They also calculated her redundancy based on her part time wage rather than her previous full time one. Anyway, she did make a fuss and the company did decide to work it out on a pro-rata basis. So I reckon you should bring it up with HR and see where it gets you. Good luck!

In my company it was based on your highest contracted salary in the last 12 months. I had returned from mat leave and gone from 4 days to 2 six months previously, so my calculation was based on my 4 day a week salary. I was delighted!! I don't know if there's a legal basis for that or if that was just their choice.

there is a limit also, i believe, to 20 months pay
