Company I temp for want to take me on directly rather than as a temp?for another job

where do I stand ?any advice would be great thanks in advance.

Or should I go through agency for the other job.

Is the agency handling the recruitment for the other job? Or, assuming the other job is permanent, does this agency only handle temp placements?

I think the company should pay the agency a finder's fee for you, what are they proposing to do?

Hi tripot the answer is no as the other job has not been advertised, it would be a new job,sas a job share with one of their staff for full time, im only temporary although been there a long time.

Dont know what they are doing yet but my old job once I leave there would be two new jobs openings.

I could get more money directly with the company rather than the agency.

That if I leave the agency and take the other job they can take me to court for no fee paid.

I'm not an expert, but I'd say it would depend on the contract this company signed with the agency you are temping for.

Most temp contracts state that if the temp (ie you) is offered employment of any kind - within a certain time period of leaving the temporary position - then a finder's fee is payable (not by you, but by the company who is using your agency).

Also, check what you signed when you signed up with the agency - they may have included this in your contract too, ie that you cannot accept employment from the company they placed you in.

Are they offering you a proper employment contract, or do they want you to work on a freelance basis for them?

The company you are working in should have a copy of the contract they signed with the agency when they took you on though - I would get them to check that before they do anything.

It may be that as you have had such a long temp contract the finders fee is reduced on a sliding scale, so it may not be too big a deal for them to just pay it.

No one will be able to take you to court for fees. Depending on their contract with the agency, the employer may have to pay a fee to the agency, but that's between them - you won't owe anyone any fees.

Thank you Flowery and Bonfire im going to find another job to tie me over as a back up and I will make my decision once they offer me the postion and still work for them in the meantime. on a part time basis .

Another thing is that if they are trying to take you off the agencies books without paying them their fee - i.e.. in a sort of underhand type way, they might be a slightly underhandish sort of company who, in the future, might treat you in a similar type way. Don't want to put you off but I used to work for an agency and dealt with this and sometimes ended up like this. Good luck

I've gone from temp to perm, btw, actually in the same role. Personally I think it's a good way of recruiting people but it has to be done above board.

As the others have said, this is really a problem for your company (that's you're temping with) to work out with the agency. It isn't uncommon so it shouldn't be a big deal, and they should consider that the finder's fee may be less than they would pay in recruitment costs otherwise.

Sorry should say that when I said about checking the contract that you (as opposed to the company) signed with your agency, that's really just to double-check your position if the company took you on without paying the fee.

It's very unlikely that your contract says you'd be liable for a fee of any sort - it probably just says something like 'if you are offered direct employment by any of our clients then you must tell us about it'.

Thanks for all your advice,I would rather they pay the fee tbh and If they want me then they pay the fee outright or they take me on through the agency and I request more money, fair deal I think.
