He is not entitled to paternity leave as he won't have been there long enough, but can his new employer raise any objection to him having time off to attend the birth etc?

I guess it depends on the employer, my DH started a new job just as I was about to give birth (and he was supposed to be working 2 hours away...), and the employer just told him to start a bit later so that he could be with us.
Is your dh's new boss aware of the sitation?

Dh will probably be starting a month or so before due date (not resigned yet and will accept the job today), and needs to have the conversation with the new employer. I was just wondering what was reasonable - I'll have good back up once I'm out of hospital, but we want dh to be there for the birth and at least the day after, especially as it looks like I'll be having a cs.

dh did this and took a whole week off (most as annual leave)

i think it could be agreed to take emergency annual leave at the point you go into labour for at least a week - i know i'd give that to my staff anyway.

but you say you may have a cs - if this going to be elective then you'll have the date booked when he starts new job so he could agree annual leave in advance.

does he already have annual leave booked from current employer for this period? new employer would honour this.

even if you were to go into labour while he's at work, i don't think anyone will stop him from leaving to be with you - they'll all be very excited too.

He's entitled to emergency unpaid time off to care for you. He can take whatever is "reasonable" in the circumstances - with a c/s I would have thought this would certainly be a few days. It is unpaid though.

Most employers would allow an employee to take paid annual leave in this case.

My husband was in this position. The answer is it depends what's in his contract. My hubby didnt qualify so took a few days carers leave.

Hi this happened to my partner and he was allowed 2 weeks off unpaid (well a little bit more than 2 weeks as I gave birth early hours of friday morning.) I think most reasonable employers would give him the time off unpaid.
