Additional 26 weeks maternity leave

Hello

Have been with same employer for over 6 years. Just taken the 26 weeks basic maternity leave (6 weeks at 90% of salary and 20 weeks at £105 - they are a stingy employer and offer the basic on everything!) I have now requested 26 weeks additional leave unpaid. My employer is saing they will think about my request and the effect it will have on the business blah blah and get back to me. I had believed it was an entitlement? It is an employer of 50+ people? Can they refuse? - I have not asked for any change of hours or any change to my terms and conditions. Any ideas?

Women who have completed 26 weeks? continuous service with their employer by the beginning of the 14th week before their EWC can take additional maternity leave. Additional maternity leave starts immediately after ordinary maternity leave and continues for a further 26 weeks. Additional maternity leave is usually unpaid

and it also says

t is assumed that a woman will take her full leave entitlement (either 26 or 52 weeks, depending on whether she qualifies for Additional Maternity Leave) and then return to work. If she wishes to return before she has used all her maternity leave then she must give her employer at least 28 days? notice of her new return date.

would also add that if I was to take the additional 26wks I would accrue a/l at 20days prorata. this is nhs - not sure it is across the board but would check.

It's your right, my boss was fuming (my replacement was rubbish) when i decided to take an extra 4 months off after my normal 26 weeks maternity, but there was nothing he could do about it. I also accrued holidays on my 26weeks off, not sure if i was still accuing them in my extra time though.

all the time you are off all your other rights continue, i.e. accruing hol pay, you should treat it as if you ae working IYSWIM your just not there!
