Annualised Hours, Christmas Bank Holidays & Days Off in Lieu....

I'm hoping there are some employment experts out there who can help unravel the working practices of the company DH works for...

He works annualised hours and his contract says that he works all bank holidays except Christmas Day and New Years Day which are paid days off and calculated in the annualised hours.

This year they fall on a Sunday which is one of his normal working days. He will be working the bank holiday Tuesday after Christmas and the bank holiday Monday after New Years Day which would normally incur double time and a day off in lieu.

His company is saying that the days off in lieu will have already been taken as they are not working Christmas Day and New Years day (classing these as the lieu days)

This doesn't sound right to me - can they do this?

His normal annual leave entitlement, say 20
PLUS Christmas and New Years Day off paid, add 2
PLUS a day in lieu of all other bank holidays and double time? add 6 total 28 days.

This year he is getting
His normal annual leave entitlement 20

PLUS a day in lieu of all bank holidays except the Tuesday and Monday? add 6 total 28

Sounds right to me, or have I miscalculated. You need to look at the number of days off he's getting to see whether he's getting his entitlement.

thanks both.

He doesn't get any time off in lieu or extra payment for any of the other bank holidays except the Tuesday & Monday mentioned in my OP and he has to work them (Good Friday not included as Friday is not one of his normal working days). His leave entitlement is calculated to take these into account, or something...

I'm not sure how many days he's entitled to, tbh Blush I'm easily confused!! I'll email him (he's at work) to find out.

Ok yes do that. It sounds complicated as annualised hours often is but it boils down to whether he's getting the right total amount of paid time off or not.
