What is the legal minimum amount of time you must take off work?

Does anyone know what the legal requirement is for taking holiday? I have lots of holiday accrued - mostly due to fact worked part time but had to do lots of extra time that got given time off in lieu for and now I think I have to take the holiday off due to "health and safety " concerns. Is there a legal requirement for how much time off you must take if you work part time? Something like health and safety legislation? Thanks

I am in the same position as you and weirdly now have more holiday than I know what to do with. My company will let people take 5 days holiday over. Mine is my pt equivalent of this - 2.5 days. So I'm taking holiday before the year is over which is end of December.

I don't know about health and safety, but I'd take it and run!

you do not have to legally have the holidays - have you asked if you can be paid for them instead if you do not want to take time off

The legal minimum holiday that must be given in any year is 5.6 weeks including public holidays - this is pro-rated for part time employees.
This is the minimum holiday that should be taken within a holiday year - you should be given opportunity to take this, and your employer cannot request that you get paid for it instead of taking it.
Anything over and above this (I think) can be paid or rolled over depending on your company policies.

Whether they will pay you for it will depend on their policy. We only pay it if we have prevented it being taken.

The legal minimum you must have is 5.6 but the legal minimum you must physically take off in a year is 4 weeks according to the Working Time Directive. The rest you can carry over by agreement.
