Pls help me with this! work have under paid me - they say they haven't !!

Ok Maths isnt my strong point but my manager says i am in the wrong on this!
I work 16 hrs a week
mon 5.5hrs
Tues 5.hrs
Fri 5.5 hrs.
Few weeks ago dd was ill so i left work on monday at 11.45pm. I started at 9.15
so I did 2.5 hours.
I then made up my hours, i did wed, thurs, fri 5.5hrs each totaling 16.5.
So i work 19 hrs that week and i claimed 3 hrs overtime.
Got my pay slip and they deducted 4 hrs pay. but paid me for the hrs hours overtime. My manager says this is right but i cannot see how! She kept saying 'your not getting it'! Please give me your thoughts because i cannot see how she is right. Thanks

How are you usually paid? Weekly or monthly?

Does the deduction make your wage below the National Minimum Wage?

Do you have an employment contract which expressly states they may make deductions from your wages and in what circumstances? And if not have you agreed in writing to the deduction?

Absent without authorised leave? Or unpaid emergency leave?

Does your employer dispute the other hours you worked?

I work for a multi national. They are great but do not pay me if I have to have time off to look after my child. If I'm ill they pay me, of course, but not to look after my sick child. I'll bet it's this.

I am paid monthly. I am not paid for absent leave. I havent agreed this deduction. The agreement was with the head of my department ( my manager was on sick at the time) that i can work back the hours.

Ok so you agreed to work the time back in lieu of the time off. Do you work the same hourss every week and then claim the overtime regularly? Is this an ongoing arrangement?

Sorry for all the extra questions - just trying to build a picture and check that it's not something obvious.

Did you have any other hours off that month which you would not be paid for? Medical appointments? Emergency leave for a dependent?

Without taking time back into play, you only left 3 hrs early anyway, where has the extra hr from? How bizarre!

dont know where the extra hour has come from! I cannot see where she is coming from! Im hitting a brick wall with her!

Katiemiddleton - I did not take any other unpaid leave off that month. In the past i have when i have had to take dependent leave i have worked back the hours and no money has been deducted

I can't see it either. I would put it in writing exactly as you have here and ask for an explanation regarding the deduction by the end of the week.

If you do not get a reponse, or the reponse you want, then write again, this time saying you believe they have made an unlawful deduction and to please investigate and put right as soon as possible. Then if still no joy after 28 days you could make a claim to an employment tribunal for unlawful deduction of wages.

I bet after the first letter things will get moving. Especially if you cc in your manager's boss who agreed the arrangement when she was off sick.

It might be worth asking for their calculation as well. Which hours did they count, which were counted as overtime, which as normal time, which were considered unpaid and why? That should quickly reveal where the problem lies.
