Can I hand my notice in and start at my new job the next day?

Hiya,

I'm on maternity leave at the moment, my current work won't let me go part-time so I've been job hunting. I was just wondering, if I find a new part-time job and hand my months notice in, can I start working for the new place straight away?

I don't see why not really - as I'm not working at the moment anyway, they might never even find out..

you will need a p45 from your old job. they will find out.

I don't think you can be serving notice from one company and be working for someone else. It's not legal.

you would still be in receipt of maternnity pay for the months notice and you cant work and recieve that so no you cant do that.

Any chance they would waive your notice period?
I assume you'll need to pay back any enhanced maternity pay?

My maternity allowance has stopped now as I've been off for more than 9 months.. ( I wasn't there long enough to get statutory through the company.)

I did wonder whether to just be upfront and try to negotiate with them so I didn't have to "work" the notice, nobody's going to gain anything from me sitting at home for a month..

Best bet is to talk to your employer - if they say no you have to wait out your notice you know where you stand. You never know, they might be pleased if you present this as an option.

As for just working for the other company while still under contract with your current employer, there will be all sorts of caveats in your employment contract. Best to be honest!
